By subscribing to use NanoTeL services, you agree to the following terms and conditions:

Rates and charges for services provided are available at the NanoTeL website. The Applicant accepts responsibility for exchange rates and/or fees that may be applied by the Applicant’s financial institution.

Clients are advised to monitor the usage in their account and to only submit funds that are intended to fund service use. NanoTeL reserves the right to refund only through service credit if an account is canceled.  Applicant understands and agrees that NanoTeL may authorize their credit card on file where applicable to ensure validity.

The Services may only be used for lawful purposes. Applicant is expressly prohibited from using the Services to transmit any unlawful, harmful, threatening, abusive, libelous, vulgar, obscene, profane, hateful, or otherwise objectionable information of any kind, including, but not limited to, encouraging conduct that would constitute a criminal offense, infringe third party rights, give rise to civil liability or otherwise violate any local, state, national or other law.

Applicant may not use the Services to upload, post, reproduce or distribute, in any way, any information, software or other material protected by copyright or any other intellectual property right without first obtaining the permission of such right by holder.

Applicant agrees to comply with all applicable laws, regulations, or conventions including those related to data privacy, international communications, and exportation of technical or personal data.

If a Customer has any questions, concerns or complaints about the services, provided by NanoTeL they may contact NanoTeL’s Customer Service Department 24 hours a day, 7 days a week by via email.

We reserve the right to modify our Network, system configurations or routing configurations. Nothing in these Terms and Conditions will create or vest in you any righttitle or interest in a services, its configuration, or associated telephone numbers or addresses provided by us. We may, at our sole discretion and without liability, change or modify the features and functionalities of a Service or modify or replace any hardware or software in the Network or in equipment used to deliver any Service over the Network provided that this does not have a material adverse effect on the committed Service.

SMS Service:

Our service allows customers to send SMS messages to other customers’ mobile devices for personal use only.

To use the our SMS service, you must register and opt-in by following the instructions provided on our platform.

Standard messaging rates may apply as per your plan.

You may opt-out at any time by following the opt-out instructions provided on our platform. After opting out, you will no longer be able to use SMS service.

You agree to use the SMS service for personal and non-commercial purposes only. Prohibited uses include, but are not limited to:

   – Sending spam or unsolicited messages

   – Harassing or abusive messaging

   – Any illegal activities

We reserve the right to modify these terms at any time. Changes will be notified via SMS or on our website.

E911:

Applicant agrees that a fee of $1.50 per month for each E911 enabled phone number will be billed to the applicant, regardless of whether the E911 service has been used. Applicant agrees that a one-time charge of $75 per E911 call will be applied to the monthly service charges for the month in which the E911 service has been used when address or location information has been deemed to be incorrect by NanoTel.

Description of 911-Type Dialing Capabilities – Activation Required: You    acknowledge and understand that 911-type dialing is NOT automatic. You acknowledge and understand that you cannot dial 911 from this line unless and until you have received a confirming email regarding service activation generally and a primary number assignment associated with the geographic location you have provided and agree to maintain.

Once you have received a confirming email that such limited 911 dialing has been successfully activated according to this Agreement and any amendments hereto that may be posted from time to time on NanoTeL website, you may dial 911 as needed, provided that all other Service requirements, including but not limited to, power supply, broadband internet connection, internet service provider login or “timing out” (even with an automatic restart that may cause a reassignment by your internet service provider of a different session-based internet address), and Service login are activated, operational and uninterrupted for the entire duration of the call.

Power Outage:

You acknowledge and understand that 911 dialing, like the Service as a whole, does not function in the event of a power failure. Should there be an interruption in the power supply, the Service and 911 dialing will not function until power is restored. A power failure or disruption may require the Customer to reset or reconfigure equipment, connections or logins, prior to utilizing the Service or 911 dialing.

Service Outage Due to Suspension of Your Account: You acknowledge and understand that service outages due to suspension of your account as a result of billing issues will prevent ALL service, including 911 dialing.

If any charge to your payment method is declined or reversed, your payment method expires and you have not provided us with a valid replacement payment method, or in case of any other non-payment of account charges.
Any plan that comes with assessed applicable taxes, surcharges, and fees periodically, based on the details of the plan selected. These fees will be calculated based on the standard price for the service.

You agree to promptly update your account information whenever your personal or billing information changes (including, for example, your name, address, e-mail address, telephone number, credit/debit card number and expiration date or other payment method information).

You authorize NanoTeL to send you notices and information regarding your service, including via e-mail, over the Internet. If notices are sent by us to the last email address provided by you, you agree that we have provided sufficient email notice and you waive any rights to assert failure of notice.

You acknowledge that you are eighteen (18) years of age or older, and you agree that you have the legal authority to enter into this Agreement and affirm that the information you supply to us is correct and complete.

You understand that NanoTeL relies on the information you supply and that providing false or incorrect information may result in Service delays or the suspension or termination of your Service. You agree to promptly notify NanoTeL whenever your personal or billing information changes, including without limitation, your name, address, telephone number, and credit card number and expiration date, if applicable.

These terms and conditions are governed by the laws of Florida.
